Πιο συγκεκριμένα από την νομολογία του αρείου πάγου προκύπτει ότι για το ορισμένο της ένστασης δόλιας υπερχρέωσης απαιτούνται …………………… . Αν ο πιστωτής δεν αναφέρει αυτά τα στοιχεία, η ένστασή του είναι αόριστη και πρέπει να απορρίπτεται από το Δικαστήριο και στις πλειονότητα των περιπτώσεων οι τράπεζες δεν έχουν επικαλεστεί αυτά τα στοιχεία.

Εφόσον, λοιπόν, η αίτησή σας Ν.3869/2010 (Κατσέλη) απορρίφθηκε και σε δεύτερο βαθμό (σε έφεση) λόγω δόλου, θα πρέπει να καταθέσετε αίτηση αναίρεσης στον Άρειο Πάγο και είναι βέβαιο ότι θα δικαιωθείτε.
